Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the DriveSchool web application and related services (the "Service") provided by DriveSchool ("we", "us" or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. This document is a general template and should be reviewed by your legal counsel before going to production.

2. Eligibility & accounts

  • You must be at least 16 years old, or the minimum legal age in your jurisdiction, to use the Service.
  • You must provide accurate information when creating an account and keep it up to date.
  • You are responsible for safeguarding your password and for any activity that occurs under your account.
  • You must notify us promptly of any unauthorized use of your account.

3. Acceptable use

You agree not to:

  • Use the Service to violate any law or the rights of others.
  • Upload content that is unlawful, harassing, fraudulent or misleading.
  • Attempt to gain unauthorized access to other accounts, systems or data.
  • Interfere with or disrupt the Service, including by introducing malware or by automated scraping.
  • Reverse engineer or attempt to extract the source code of the Service, except where permitted by law.

4. User responsibilities

Instructors are responsible for the accuracy of the lesson, pricing and availability information they publish, and for delivering lessons in accordance with applicable laws and licenses. Students are responsible for the accuracy of the personal details they provide, for attending booked lessons and for paying any agreed fees. You are solely responsible for your interactions and arrangements with other users; DriveSchool is not a party to those agreements.

5. Payments

Payments processed through the Service may be handled by third-party payment providers. You agree to their terms when using their service. We are not responsible for declined payments, chargebacks or other issues arising from payment processors.

6. Third-party integrations

The Service may integrate with third-party tools (such as Google Calendar and SMS providers). Your use of those tools is also subject to the third party's terms and privacy policies. We do not control and are not responsible for third-party services.

7. Intellectual property

The Service, including its design, code and content provided by us, is owned by DriveSchool and protected by intellectual property laws. You retain ownership of the content you upload, but grant us a limited, worldwide, non-exclusive licence to host, display and process that content solely to operate and improve the Service.

8. Termination

You may stop using the Service at any time and delete your account from your settings. We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if your account creates risk or potential legal exposure for us or other users.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or completely secure.

10. Limitation of liability

To the maximum extent permitted by law, DriveSchool and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold harmless DriveSchool from any claims, losses or expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

12. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we will provide reasonable notice through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which DriveSchool is established, without regard to its conflict of laws rules. Any disputes will be resolved in the courts of that jurisdiction, unless required otherwise by mandatory law.
